1) Definition:
(a) User Subscription shall mean paid users using our paid services. All other information displayed on our website is for information purpose and should be treated as complimentary to any other principal source.
(b) "Subscription Charges" means the price/compensation/registration fee payable to the SchoolAlerts Solutions Pvt. Ltd. as may be defined from time to time, under and in accordance with the terms and condition laid herewith. It varies from Individual to Group Institution as per our subscription Model. The Subscription will be applicable for One Academic Year only and users who have paid for it will only be entitled to receive information specified under the same model. In case an User wants to continue the services, they should renew the subscription every year. Else, the rights to paid services can be taken away, at company's discretion. Registration Fees paid is for the particular event and cannot be carried forward or refunded in case of Absenteeism.
(c) “Service(s)” means all the services as specified on our website. Subscription based information is separate than the generic information specified on our website.
(d) “Business Day “means any day that is not a Sunday or a public holiday (as per the official holidays observed by Government of India/Banks).
(e) "Confidential Information" means, (i) intellectual property information; (ii) technical or business information or material not covered in (i); (iii) proprietary or internal information related to the current, future and proposed products or Service(s) of the Parties including, financial information, process/flow charts, business models, designs, drawings, data information related to products and Service(s), procurement requirements, purchasing, customers, investors, employees, business and contractual relationships, business forecasts, business plans and strategies, information the Parties provide regarding third parties; (iv) information disclosed pursuant to this Agreement and (v) all such other information which by its nature or the circumstances of its disclosure is confidential.
(f) "Document" means any embodiment of any text or image howsoever recorded and includes any data, text, images, sound, voice, codes, computer programmes, software and / or databases or microfilm or computer generated microfiche or similar device.
(g) “Effective Date” means the start of Admission Session till the end of Admission Session. Typically the cycle from Sept / Oct of every year till March / April of the next calendar year.
(h) "Intellectual Property Rights" means any patent, copyright, trademark, trade name, design, trade secret, permit, service marks, brands, propriety information, knowledge, technology, licenses, databases, computer programs, software, know how or other form of intellectual property right, title, benefits or interest whether arising before or after the execution of this Contract and the right to ownership and registration of these rights.
(m) "Site" means the website.
(n) "Events" means online and onsite/offsite events.
2) Indemnity & Liability
2.1) Indemnity: The users indemnifies the School Alert, its directors, employees, agents and representatives from and against any costs, loss, damages, expense, claims, litigations, suits, actions, judgments, and or otherwise including but not limited to those from third parties or liabilities of any kind howsoever suffered, arising out of or incurred inter alia during the subscription period.
2.2) Liability: The maximum liability of the vendor shall be limited to the subscription payment received for that particular session from the User Or to the registration fees paid for any particular event organized by SchoolAlerts. Nothing additional will be payable to the User in any circumstances for any financial or non-financial loss.
2.3) We may appoint external judges / team for evaluation for various events. Their judgment is purely on merit of the student/work received. Schoolalerts Solutions Pvt. Ltd. is not responsible for their judgement. We may review the decision, only if required. Else, their decision stands final and irrevocable.
3) Delay in the Performance
Since we are dependent on information from Primary Sources, there might be some delay in gathering and validating the information received by us. However, we will try to be as quick as possible. Users are to provide proper communication details such as Email Id, Phone Numbers, Social Media Account Id, etc. at all times. We will not be responsible for communication going to wrong ids, as provided by the user. The same can be corrected only once the User identifies their mistake and informs us in writing or makes a Change Request. By no means, should we be held liable for Users action or Mistakes.
4)Payment:- Every Academic Year
- Individual Users - Rs. 100.00 per Registration / Mobile Number Registration
- PlaySchool / Pre-School (Per Center) - Rs. 799.00 per Registration
- PlaySchool / Pre-School (3-5 Centers) - Rs. 699.00 per Center
- PlaySchool / Pre-School (More than 5 Centers) - Rs. 599 per Center
The payment may change from time to time as notified on the registration page. SchoolAlert management has all rights and is flexible to modify the pricing model or prices at any point of time.
Only registered Users, PlaySchool / Pre-School can access and use the information provided by us. Any misuse by non-registered institution or individual may lead to legal course in Court of Kolkata (India).
5)Payment Terms
All payments have to be made in advance and to the specified details provided on our website. We will not be responsible for non-receipt of payments due to erroneous transfers to different accounts and will not entertain any requests in this regard. The subscription will become active only when the payment is received by us and confirmation sent. No Credit is allowed and we will in no manner be liable to provide any services without payments.
We may run promotional offers from time to time and similarly our partners may run promotional offers as per their convenience. We will be responsible only for cashback / promotion offer run by us. Users need to contact Partner is case of discrepancy to promotional offer run by our partner. We will not be responsible in any way for their offers and no requests will be entertained with respect to the same.
6) Liquidated Damages
We will always try to provide information on time. In case of lapse in our services, our liability will be limited to the subscription amount received for that particular academic year or the Event Registration Fee received for the event. Since the very nature of our services is providing complimentary information to primary source, we are highly dependent on information from primary sources.
SchoolAlerts.in is no way associated to any schools, colleges or other educational institute or management of such institutes and does not guarantee anyone admission. Admissions to Schools, Colleges are based on their own processes and candidates abilities or capabilities. We do not influence these processes and do not encourage such requests.
7) Dispute resolution mechanism
The User and we, shall endeavor their best to amicably settle all disputes arising out of or in connection with our services in the following manner:
a. The User raising a dispute shall address to us a notice requesting an amicable settlement of the dispute within seven (7) days of receipt of the notice.
b. We will review and revert with all transcripts / details within 14 days from the receipt of the notice and discuss with the User. In case the User is at fault, no complaints will be entertained further and no penalty will be payable. In case, we are at fault, we will refund the necessary subscription charges within 60 days from the date of identification.
In case any dispute between the User and Us is not settled by negotiation in the manner as mentioned above, the same may be resolved exclusively by arbitration and such dispute may be submitted by either party for arbitration within 50 days of the failure of negotiations.
8) Force Majeure
Force Majeure is herein defined as any cause, which is beyond the control of us as the case may be which they could not foresee or with a reasonable amount of diligence could not have foreseen and which substantially affect the performance of our services such as:
• Natural phenomena including but not limited to floods, droughts, earthquakes, epidemics.
• Acts of any Government including but not limited to war, declared or undeclared, Priorities, quarantines, embargoes.
• Terrorist attacks, public unrest in the State
SchoolAlerts.in shall not be liable for delay in performing his/her obligations resulting from any Force Majeure cause as to and/or defined above.
9) Ownership and Retention of Documents
a) SchoolAlerts.in shall own the documents, prepared by SchoolAlerts.in arising out of or in connection with the Services provided by us or received during any of our events.
b) User cannot forward or misuse the documents provided by us, until and unless, agreed by us in writing. Users forwarding or circulating information provided by us, without our knowledge will be bound for any legal action.
10) Subscription Cancellation (Termination)
No cancellation allowed post receipt of Subscription/event registration fee payment. Users are requested to think and then subscribe. No refund will be payable by us in any circumstances. The Services start from the time the payment is received from you and successful confirmation shared/received.
11) Termination for Convenience or Cause
No Termination for Convenience allowed post payment of Subscription Charges. Hence, request users to subscribe to our services. No refund will be made.
In case if a User gets transferred to a different city where we provide or do not provide services, the User has to re-register specifically for that region or city. Under no circumstances, the registration is transferable. A mobile number registered under subscription model can be changed only if the number is lost / surrendered to the Service Provider / No longer in User. Document Proof to be produced for such changes. Else, User needs to re-register themselves.
12) Governmental restrictions and clearances
Services and deliverables covered are subject to regulations of Government of India. Such services and deliverables may change from time to time as per direction received from Government of India or any other regulatory bodies in India.
13) Coverage
We are covering or will be covering the areas/cities as mentioned on our website. Any Place / City / State / Country not mentioned on our website, is not covered currently but it is there in our roadmap. Users are requested to check the location coverage before subscribing.
This website is created for providing information services to its users. We depend on information provided to us from various sources including School, Colleges and Educational Institution. The accuracy depends on the source information received. The same may change from time to time depending upon the changes made by Source Institution. We will try to provide accurate information in whichever way possible and in the fastest way. This is a complementary service to the existing sources. However, we recommend our users to keep a close watch on other sources of information too.
14) Jurisdiction
All cases should be referred and fought in Court of Kolkata, India.
